1. Introduction to Local Government
- Definition: Local Government is the management of local affairs by the people of that locality through their elected representatives. It is the third tier of government (grassroots democracy).
- Significance:
- It deals with local problems directly and efficiently.
- It encourages local participation and leadership.
- It reduces the burden on the Central and State governments.
2. Historical Background & Evolution in India
- Lord Ripon (1882): Often called the "Father of Local Self-Government" in India, his resolution laid the foundation for local bodies.
- Government of India Act, 1919 & 1935: Local bodies were given further impetus under provincial autonomy.
- Community Development Programme (CDP), 1952: Aimed at rural development through local participation, though it had limited success.
- Balwant Rai Mehta Committee (1957): Recommended a 3-tier Panchayati Raj system (Gram Panchayat, Panchayat Samiti, Zilla Parishad).
3. The 73rd Constitutional Amendment Act, 1992 (Rural Local Governments)
This landmark act gave constitutional status to Panchayati Raj Institutions (PRIs) in India.
Key Features:
- Three-Tier Structure: Uniform system across states having a population above 20 lakhs:
- Village Level: Gram Panchayat
- Block Level: Mandal Panchayat / Panchayat Samiti
- District Level: Zilla Parishad
- Gram Sabha: Comprises all registered voters in a village. It is the foundation of the Panchayati Raj system.
- Elections: Direct elections for members at all three levels. The chairperson is elected indirectly.
- Reservation of Seats:
- Seats reserved for Scheduled Castes (SCs) and Scheduled Tribes (STs) in proportion to their population.
- Not less than one-third (33%) of total seats reserved for Women.
- Tenure: Fixed 5-year term for all local bodies. If dissolved prematurely, elections must be held within 6 months.
- State Election Commission (SEC): An independent body created to conduct elections to local bodies.
- State Finance Commission (SFC): Appointed every 5 years to review the financial position of local governments and recommend grants.
- Eleventh Schedule: Contains 29 functional items transferred to Panchayats (e.g., agriculture, health, sanitation, primary education, rural housing).
4. The 74th Constitutional Amendment Act, 1992 (Urban Local Governments)
This act provided constitutional status and uniform structure to urban local bodies (Municipalities).
Key Features:
- Types of Urban Local Bodies:
- Nagar Panchayat: For areas in transition from rural to urban.
- Municipal Council: For smaller urban areas.
- Municipal Corporation: For larger urban areas.
- Structure & Elections: Headed by a Mayor (in Corporations) or President (in Councils/Nagar Panchayats) elected by/from elected ward members.
- Reservations & Tenure: Similar to the 73rd Amendment (1/3rd reservation for women, SC/ST reservations, 5-year fixed term).
- Twelfth Schedule: Contains 18 functional items transferred to Municipalities (e.g., urban planning, fire services, water supply, public health).
5. Implementation and Challenges
- Successes:
- Deepening of democracy at the grassroots level.
- Inclusion of marginalized groups like women, Dalits, and Adivasis in governance.
- Major Challenges / Shortcomings:
- Lack of Financial Autonomy: Dependence on state government grants due to limited local tax collection.
- Bureaucratic Dominance: Interference of government officials and local MLAs/MPs in local matters.
- Lack of Proper Devolution: Many states have not fully transferred all subjects listed in the 11th and 12th Schedules to the local bodies.
